Notice - August 3rd 2009
This Permit is being issued and administered by the Navajo Nation EPA (NNEPA) pursuant to the Delegation Agreement between EPA Region IX and NNEPA, dated October 15, 2004. This permit authorizes the Permittee, ConocoPhillips – Wingate Fractionating Plant, candlestick flare, Unit ID No. 17, to operate air pollutant-emitting activities in accordance with the permit conditions listed in this permit and the provisions of Title V of the Clean Air Act, 40 C.F.R. Part 71, Navajo Nation Operating Permit Regulations, and all other applicable rules and regulations.

The Navajo Nation Environmental Protection Agency (NNEPA), Navajo Air Quality Control Program (NAQCP), Operating Permits Program (OPP) section is accepting written comments on the renewal of a Part 71 permit for Peabody Western Coal Company (Black Mesa Complex) – Peabody Western Coal Company.

Air Quality Section

The Navajo Air Quality Control Program is subdivided into two sections;
the Air Quality Section and the Operating Permit Section.
Air Quality Section
The Air Quality Control Program initially started as a air monitoring program and has since grown to include several programs. Follow this link to learn about how AQCP staff are working toward safeguarding air quality.

Program Objectives
- To develop air quality regulations under the Navajo Nation Air Pollution Prevention and Control Act, and to implement an air permitting program.
- To maintain and expand particulate and gaseous air quality monitoring network.
- To update and maintain the emission inventory.
- To continue participation in the local and regional air quality related activities.
- To provide training for air quality staff.
Monitoring Air Quality
Monitoring stations across the vast Navajo Nation collect ambient air quality. Data is used to determine air quality trends and impacts.
Regulations and Rulemaking
The AQCP staff work closely with the Natural Resource Committee of the Navajo Nation Council in developing legislation to mitigate air quality impacts. Link also provides a listing of Navajo Nation Air Quality Laws enacted and provides an overview of the Navajo Nation Council legislative process for rulemaking.
Emission Inventory (Minor Sources)
An emission inventory of minor sources impacting air quality is underway. Information collected will help determine with more accuracy Navajo air shed impacts by small businesses and other minor sources.
Asbestos NESHAP
To protect public health from exposure to regulated asbestos-containing material (RACM) during National Emission Standards for Hazardous Air Pollutants (NESHAP) facility renovation and/or demolition activities, asbestos removal, transport and disposal, and closely monitoring those activities for proper notification and asbestos emission control. Asbestos is a known human carcinogen and is known to cause other respiratory disease.
Environmental Outreach
Bilingual (Navajo/ English) air quality environmental education outreach is available to Navajo Nation schools (K-16). In addition, public outreach is available for community events and chapter meetings. Please follow the link to access more information on how to request. More details...
Open Burn Permit
These proposed regulations discourage open burning disposal practices where alternative methods are feasible and practicable. They encourage the development of alternative disposal methods and the use of the highest and best practicable burning methods to minimize emissions where other disposal practices are not feasible.
